1. Introduction: Welcome to NexoMoodora. NexoMoodora respects your privacy and is committed to protecting your personal data. This Privacy Statement will inform you as to how NexoMoodora handles your personal data, your privacy rights, and how the law protects you.
2. Data Controller: Under the GDPR, NEXORA GROUP LTD is a data controller for the personal data collected from all categories of data subjects listed above, with the following exceptions: NEXORA GROUP LTD is a data processor of the user logs, administrative user logs, and some account settings information. In addition, NEXORA GROUP LTD is a data processor for any of the information provided by the user through the website that transit. Where NEXORA GROUP LTD is a data processor, NEXORA GROUP LTD processes data on behalf of the user under their data processing instructions.

The Data NexoMoodora Collects: NexoMoodora may collect, use, store and transfer different kinds of personal data about you, including: Identity Data (e.g., your name), Contact Data (such as your email address and other identifiers you might use), Financial Data (e.g., your payment method details), Technical Data (e.g., IP address, network), Profile Data (your username, password, etc.), Usage Data (information about how you use and interact with NexoMoodora’s website, products and services), Marketing and Communications Data (your preferences in receiving marketing from us and our third parties and your communication preferences), information about your interactions with customer support (date, time and reason for contacting, transcripts of any chat conversations, your phone number and call recordings) and information collected via the use of cookies (“Cookies Policy”).

How NexoMoodora Collects Your Data: NexoMoodora uses different methods to collect data from you and about you, including: direct interactions (such as when you subscribe and use the services), automated technologies or interactions, and third-party or publicly available sources. “Mandatory” personal data requested by NexoMoodora are legally or technically required for the provision of the services.

How NexoMoodora Uses Your Data: NexoMoodora will only collect and use your personal data upon your consent, when the law allows it to, and only to the necessary extent for the purpose of the collection. Most commonly, NexoMoodora will use your personal data to process payment for your account; to process, deliver and track your orders; determine your general geographic location; manage your membership; inform you about any changes; communicate with you regarding your order; send you newsletters and activity materials; and to improve its services.

Disclosure of Information: Upon your consent, NexoMoodora may share your personal data within NEXORA GROUP LTD for administrative purposes (including potential merger), analysis and statistical purposes (assessing credit risk), in order to defend against legal claims and to comply with legal obligations (including court orders), to prevent, detect and investigate potentially prohibited or illegal activities (including fraud), and to enforce its Terms of Use. Further, NexoMoodora may disclose your information for certain purposes to third parties/service providers. For instance, NexoMoodora uses service providers to perform services on its behalf such as providing IT services; customizing, personalizing, monitoring and auditing its services; providing bank account or balance information; and processing credit card transactions or other payment methods. These service providers may have access to your personal data in order to provide their services and NexoMoodora does not authorize them to use or disclose your personal data for other reasons.
7. Data Security: NexoMoodora has implemented appropriate security measures to prevent your personal data from being accidentally lost, used, accessed in an unauthorized way, altered or disclosed. NexoMoodora follows PCI security standards in order to ensure the protection of confidentiality, and any payment transactions are encrypted. You acknowledge that your personal data can be stored at a destination outside the European Economic Area.

Data Retention: NexoMoodora will only retain your personal data for as long as necessary to fulfill the purposes NexoMoodora collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. When your personal data are no longer required, NexoMoodora will take reasonable measures to destroy them in a secure manner. The deletion period when your account is deleted is: immediately for the user’s data and account information; 3 years for the customer’s service data; 1 year for voice recordings; and 10 years for transaction data.
9. Your Legal Rights: Under certain circumstances, you have rights under data protection laws in relation to your personal data.
10. Access to Account: To simplify your account access, you can use the “Remember me” function when you log in to avoid re-entering your identification. If you provide others with your account access, you acknowledge that they will have access to your personal data. From your account you can update your personal information.
11. Changes to This Privacy Statement: NexoMoodora will update this Privacy Statement from time to time in response to changing legal or operational requirements. NexoMoodora will notify you of any changes in accordance with law. Upon an update, if you continue to use NexoMoodora services, you acknowledge that you accept those changes. If you do not accept the changes, you can cancel your membership.
